The Real Property Notification System (RPNS) is designed to allow individuals to receive notifications when certain real estate and personal property records are filed with, indexed, and data transmitted by Clerks of the Circuit Court throughout the state of Maryland. Individuals may opt-in to this voluntary system designed to send an electronic notification of the filing of a document in select official county records when document index data entered and transmitted to the Maryland Judiciary by the Clerk matches the notification criteria set. All notifications will be forward-looking and generated for documents filed and index data received after the date the user creates a notification request. All user notifications generated by the system are entirely dependent upon index data entered and transmitted by the Clerk of the Circuit Court in the county of filing. As a result, any notices generated by this system are not guaranteed by the Maryland Judiciary to be comprehensive, accurate, complete, or current, and are not official Court records. The user of the system acknowledges these conditions and these general terms and conditions of this website. Users will have the ability to set additional restrictions and notifications of their choosing.

By requesting any notifications, I acknowledge and agree that:

  • I will only use this system to establish requests for notifications related to property I own or on behalf of an individual who has authorized me to request notifications.
  • I will not use this system to create notifications for research, fraud, harassment, stalking, or commercial purposes.
  • All notifications generated by the system are entirely dependent upon index data entered and transmitted by the Clerk of the Circuit Court in the county of filing and imported into the system. The timing of document data imports into the system varies by county. As a result, any notices generated by this system are not guaranteed by the Maryland Judiciary to be either comprehensive, accurate, complete, or current and are not official Court records.
  • Documents that are not indexed and transmitted by the Clerks of the Circuit Court may be filed that may contain reference(s) relevant to my property. I will not receive any notifications in such instances.
  • No notifications will be generated until I create at least one notification request. Registration alone will not generate any notification.
  • I am solely responsible for the notification request criteria settings that I enter which are used by the system to generate notifications.
  • Notifications will only be generated for applicable documents filed with a Clerk of the Circuit Court following the date I create the notification request. No notifications will be generated for any documents filed prior to such date.
  • I will create only a single account using a single email address and/or phone number for the purpose of receiving applicable notifications.
  • Users are limited to a cumulative total number of requests as determined by the Maryland Judiciary, which may review and revise the notification policy from time-to-time without notices other than posting on its site.

Text Messaging Service

By requesting an RPNS login or verification code, enabling SMS notifications during registration, enabling SMS notifications in Notification Preferences, or otherwise opting in to an RPNS text messaging service (each, a "Text Message Service"), you accept these Terms & Conditions.

RPNS text messages are transactional messages from the Maryland Judiciary/RPNS. RPNS does not send marketing or promotional text messages.

Login and verification codes. If you request a login or verification code, RPNS may send a one-time login or verification code by text message to the mobile number you provide. This code is used for the login or verification request. Requesting a login or verification code does not enroll you in recurring RPNS SMS notifications. Message and data rates may apply.

RPNS property notifications. If you choose to receive SMS notifications during registration or in Notification Preferences, RPNS may send recurring property-notification text messages to the mobile number you provide or confirm. These messages may be sent when certain real estate or personal property records match the notification criteria in your RPNS account. Message frequency varies based on property activity, county data imports, and your notification settings. Message and data rates may apply.

Consent to SMS notifications is optional. Consent to receive RPNS property-notification text messages is not required to register for or use RPNS. Email notifications and other non-SMS notification options, when available, may be used instead of SMS notifications. You may opt in to RPNS property-notification text messages during registration or later in Notification Preferences by selecting the SMS notification option, confirming the mobile number that will receive SMS notifications, and completing any required verification-code step.

Help and opt-out. For help with RPNS text messages, reply HELP or contact the Maryland Judiciary customer service at 410-260-1114. To stop receiving text messages from the RPNS toll-free number, reply STOP. You may also disable RPNS property-notification text messages in Notification Preferences. Because RPNS uses one toll-free number for both login or verification codes and property-notification messages, replying STOP may block all SMS messages from that number, including login or verification codes, until you reply START or otherwise re-enable SMS where permitted.

The Maryland Judiciary may terminate any Text Message Service or your participation in it at any time, with or without notice, and these Terms & Conditions will still apply. I consent to the handling of my information as described in the Maryland Judiciary privacy policy found herein. Users must be 18 years of age or older, except in Alabama and Nebraska where users must be 19 years of age or older.

Mobile Carriers

Text Message Services used by the Maryland Judiciary are supported on most U.S. carriers. Supporting mobile carriers may change without notice, and a particular Text Message Service may be limited to specific carriers. The Maryland Judiciary and the mobile carriers are not liable for delayed or undelivered messages.

Definitions

"Text Message Service" includes any arrangement or situation in which the Maryland Judiciary/RPNS sends, indicates that it may send, or receives a request that it send one or more text messages, including one-time login or verification codes and optional RPNS property-notification text messages.

Users may not use the website and services in any manner that could damage, disable, overburden, or impair any Maryland Judiciary server, or the network(s) connected to any Maryland Judiciary server, or interfere with any other party's use and enjoyment of the website and services. Users may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the website and services. Illegal and/or unauthorized uses of the website, including, but not limited to, unauthorized framing of or linking to the website, or unauthorized use of any robot, spider, or other automated device on the website, will be investigated and appropriate legal action will be taken, including without limitation civil, criminal, and injunctive redress. If you violate any Terms of Use for any Maryland Judiciary site, the Maryland Judiciary, in its sole determination, may terminate, revoke, suspend, limit or otherwise determine your use of any Maryland Judiciary Site, bar you from future use of any Maryland Judiciary Site and/or take appropriate legal action against you.

Privacy Policy

The information we gather is either information that you voluntarily supply when you register for or use RPNS, or information gathered on usage patterns and preferences as visitors navigate the website and/or use RPNS. This may include, for example, your name, address, email address, mobile phone number, account information, notification request criteria, notification preferences, login or verification-code activity, and SMS consent records. SMS consent records may include the date and time of consent, the source page or workflow where consent was provided, the mobile number provided or confirmed, the consent language presented, verification status, and opt-out status.

To help make our website more responsive to the needs of our visitors, we use a standard feature of browser software, called a "cookie", to assign each visitor a unique, random number that resides on the user's computer. The cookie does not identify the visitor, just the computer that a visitor uses to access the website. Unless you voluntarily identify yourself, we will not know who you are, even if we assign a cookie to your computer, as the only personal information a cookie can contain is information you supply. A cookie cannot read unrelated data from a user's computer. We use cookies to help the Maryland Judiciary deliver a better, more personalized service.

Information collected by RPNS will be used to positively identify parties, administer RPNS accounts, verify account information, send login or verification codes, and facilitate notifications. This may include sending status notifications through email and/or text message. RPNS uses mobile phone numbers to send one-time login or verification codes and, when the user separately opts in, RPNS property-notification text messages. SMS messages are from the Maryland Judiciary/RPNS. Mobile phone numbers and SMS opt-in consent records are used to provide RPNS services and are not sold or shared with third parties for their marketing or promotional purposes. Users may opt out of RPNS text messages by replying STOP to an RPNS text message or by changing their Notification Preferences, where available.

Information collected will be subject to disclosure as required by law.

Conflict Resolution

You, as a User, agree that these Terms of Use and any dispute that may arise between you and the Maryland Judiciary shall be governed by and construed in accordance with Maryland law, without regard to its conflict of laws rules or any other rules directing referral to foreign law or forums. You agree that any action brought to assert any right or remedy pertaining to these Terms of Use and any dispute that may arise between you and the Maryland Judiciary shall be brought exclusively in the Circuit Court for Anne Arundel County, Maryland. User and the Maryland Judiciary expressly submits and consents in advance to such jurisdiction and waives any objection based upon lack of personal jurisdiction, improper venue or forum non convenient. If a dispute, controversy or claim, including but not limited to payment disputes, arises under these Terms of Use, You agree to work in good faith prior to litigation to resolve the dispute through negotiations with the Maryland Judiciary and, if necessary, engage in mediation. The Maryland Judiciary may exercise the right to submit the matter for mediation by providing the other party with a written demand for mediation setting forth the subject of the dispute. The parties will cooperate with one another in selecting a mediator and in scheduling the mediation proceedings. Venue for the mediation will be in Anne Arundel County, Maryland; provided, however, that any or all mediation proceedings may be conducted by teleconference with the consent of the mediator. The parties covenant that they will participate in the mediation in good faith, and that they will share equally in its costs; provided, however that the cost to the Maryland Judiciary shall not exceed five thousand dollars ($5,000.00). You agree that, in addition to any dispute resolution procedures otherwise required under these Terms of Use or any informal negotiations which may occur between the Maryland Judiciary and User, no civil action with respect to any dispute, claim or controversy arising out of or relating to these Terms of Service may be commenced without first giving fourteen (14) calendar days written notice to the Maryland Judiciary of the claim and the intent to initiate a civil action. All offers, promises, conduct and statements, whether oral or written, made in the course of the mediation by any of the parties, their agents, employees, experts and attorneys, and by the mediator or employees of any mediation service, are inadmissible for any purpose (including but not limited to impeachment) in any litigation or other proceeding involving the parties, provided that evidence that is otherwise admissible or discoverable shall not be rendered inadmissible or non-discoverable as a result of its use in the mediation. Inadmissibility notwithstanding, all written documents shall nevertheless be subject to the Maryland Public Information Act (MPIA). Should the parties be unable to reach a resolution, each party retains any and all remedies available to it, including but not limited to, commencement of a civil action subject to the defenses of the other party.
